Terms & Conditions

• Advertiser means any person or entity booking advertising inventory through CASTADI.
• Screen Partner means any individual or organization that owns, leases, manages, or operates digital advertising screens listed on CASTADI.
• Campaign means an advertisement scheduled for display on one or more registered screens.
• Platform means the CASTADI website, mobile application, Cloud CMS, Android Player, APIs, dashboards, and related software.
• Content means advertisements, text, graphics, videos, logos, trademarks, images, documents, software, and other materials.
• User means any person accessing or using the Platform.

To use CASTADI, you must:

• Be at least 18 years old.
• Have legal capacity to enter into binding contracts.
• Provide accurate and complete registration details.
• Use the Platform only for lawful purposes.
• Comply with all applicable laws and regulations.

CASTADI may request identity verification or KYC at any time.

CASTADI provides a technology marketplace that enables:

• Discovery of digital advertising screens.
• Campaign booking and scheduling.
• Digital advertisement management.
• Remote content delivery.
• Payment processing.
• Campaign analytics.
• Proof-of-Play reporting.
• Screen management.
• Device monitoring.
• Business dashboards.

CASTADI does not own or operate every screen listed on the Platform and acts as a technology intermediary unless expressly stated otherwise.

Users are responsible for:

• Maintaining account confidentiality.
• Protecting passwords and login credentials.
• All activity occurring under their account.
• Updating account information promptly.

Users must immediately notify CASTADI of any unauthorized access or suspected security breach.

Users must not:

• Upload unlawful or misleading content.
• Violate intellectual property rights.
• Attempt unauthorized access to systems.
• Distribute malware or malicious code.
• Interfere with Platform operations.
• Manipulate analytics or campaign data.
• Use automated tools to scrape Platform data without authorization.
• Create fake accounts.
• Misrepresent business identity.

Violation of this clause may result in suspension or permanent termination.

Advertisers are solely responsible for ensuring that advertisements:

• Are truthful and accurate.
• Do not violate any law.
• Do not infringe intellectual property rights.
• Do not contain defamatory or offensive material.
• Comply with applicable advertising standards.

CASTADI reserves the right to reject, suspend, remove, or modify advertisements at its discretion.

Screen Partners represent and warrant that:

• They own or are authorized to operate the listed screen.
• Screen specifications are accurate.
• Location details are correct.
• The screen is legally installed and operated.
• Required permissions and licenses have been obtained.
• Display quality and uptime meet Platform standards.

Campaign availability depends on:

• Screen availability.
• Device uptime.
• Venue operating hours.
• Technical conditions.
• Network connectivity.
• Maintenance schedules.

Campaign start times may vary slightly due to operational requirements.

Prices displayed on the Platform may vary based on:

• Screen size.
• Location.
• Audience reach.
• Time slots.
• Campaign duration.
• Demand.
• Premium inventory.

All prices are subject to applicable taxes unless otherwise stated.

Payments may be processed through approved payment gateways. Users agree to:

• Pay all applicable fees.
• Provide valid payment information.
• Authorize CASTADI or its payment partners to process transactions.

Failure to complete payment may result in cancellation of bookings.

Users are responsible for applicable taxes, including GST, TDS, or other statutory charges where required. CASTADI will issue tax invoices where applicable.

All Platform content, including software, design, user interface, logo, trademarks, source code, documentation, and databases, is owned by or licensed to CASTADI and protected under applicable intellectual property laws.

Users receive only a limited, non-exclusive, non-transferable license to use the Platform.

Users retain ownership of content they upload. By uploading content, users grant CASTADI a worldwide, non-exclusive, royalty-free license to host, reproduce, display, transmit, and process such content solely for providing Platform services.

Collection and processing of personal information are governed by the CASTADI Privacy Policy. Users consent to such processing by using the Platform.

The Platform may integrate with third-party providers, including payment gateways, SMS providers, email providers, analytics platforms, mapping services, and cloud hosting providers. CASTADI is not responsible for the availability or performance of third-party services.

CASTADI aims to maintain reliable service but does not guarantee uninterrupted availability. Temporary interruptions may occur due to maintenance, software updates, internet outages, hardware failures, or force majeure events.

CASTADI may suspend or terminate accounts without prior notice for fraudulent activity, policy violations, non-payment, security risks, illegal conduct, misrepresentation, or abuse of the Platform.

Users may terminate their account by following the Platform's account closure process, subject to any outstanding obligations.

To the maximum extent permitted by law:

• CASTADI is not liable for indirect, incidental, consequential, or punitive damages.
• CASTADI does not guarantee business results, leads, conversions, revenue, or profits.
• CASTADI's total liability arising from any claim shall not exceed the amount paid by the user for the specific transaction giving rise to the claim.

Users agree to indemnify and hold harmless CASTADI, its directors, officers, employees, affiliates, and partners from any claims, losses, damages, liabilities, costs, or expenses arising from breach of these Terms, illegal activities, intellectual property infringement, misleading advertisements, or violation of applicable laws.

CASTADI shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, war, terrorism, government actions, internet failures, power outages, pandemics, or civil disturbances.

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising from these Terms shall first be resolved through good-faith negotiations.

If unresolved, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Patna, Bihar, India.

Subject to the arbitration clause, courts located in Patna, Bihar shall have exclusive jurisdiction.

CASTADI reserves the right to update these Terms from time to time. Material changes will be communicated through the Platform or other reasonable means. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with the Advertiser Agreement, Screen Partner Agreement, Privacy Policy, Cookie Policy, Refund & Cancellation Policy, and other applicable legal documents published by CASTADI, constitute the entire agreement between the user and CASTADI regarding use of the Platform.
